This is the Privacy Policy of Europe Awake™ ("we," "us," or "our"). It explains what personal information we collect, why we collect it, how we use and share it, and what rights you have over it. This policy applies when you visit or use the Europe Awake™ website, online store, and all related services, content, features, and products (collectively, the "Services"). The Services are powered by Shopify.

Information from Third Parties

We receive information about you from third parties, including:

  • Shopify — account, transaction, and usage data related to the Services
  • Payment processors — transaction confirmation and fraud prevention data
  • Advertising partners — information about how you interact with our ads on other platforms
  • Shop app — if you create or log into your account through Shop, we receive your name, email, shipping address, phone number, and order details as authorized by that platform

Information We Derive

We may draw inferences from the information we collect. For example, we may infer your approximate location from your IP address, or infer product interests based on your browsing behavior and purchase history.

2. How We Use Your Personal Information

We use your personal information for the following purposes:

  • Fulfill orders — process payments, arrange shipping, handle returns and exchanges, send order confirmations and updates
  • Provide and improve the Services — maintain your account, remember your preferences, develop new features, and improve the shopping experience

Service Providers

De-identified Information

4. Relationship with Shopify

The Services are hosted by Shopify. Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Your information is transmitted to and shared with Shopify and its third-party service providers, which may be located outside your country of residence.

We use certain Shopify enhanced features that incorporate data from your interactions with our store, other Shopify merchants, and Shopify itself. For these features, Shopify acts as an independent data controller and is responsible for responding to your requests regarding its use of your personal information.

5. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Privacy Policy or as required by law. Specifically:

  • Account data — retained while your account is active or as needed to provide the Services
  • Transaction records — retained as required by tax, accounting, and legal obligations (typically 7 years for financial records)
  • Marketing preferences — retained until you opt out or request deletion
  • Analytics data — retained in aggregate or de-identified form for trend analysis

When personal information is no longer needed, we securely delete or anonymize it. You may request deletion of your personal information at any time, subject to legal exceptions.

6. Targeted Advertising and Analytics

We work with advertising partners to show you targeted ads on third-party platforms and to measure ad effectiveness. These partners use cookies, pixels, and similar technologies to collect information about your activity on the Services and other websites.

These activities may constitute "sharing" or "selling" of personal information under certain privacy laws, including the CCPA/CPRA. We do not sell personal information for monetary consideration. However, sharing data with advertising platforms for targeted advertising may be considered a "sale" or "share" under the CCPA.

What Are Cookies

  • Opt out of marketing emails — click the unsubscribe link in any promotional email. Opting out does not affect transactional messages about your orders or account.
  • Opt out of SMS marketing — reply STOP to any marketing text message

Exercising Your Rights

We will verify your identity before processing your request. We respond within 45 days (or up to 90 days with notice if reasonably necessary). We do not charge fees for these requests unless they are excessive, repetitive, or manifestly unfounded.

Authorized Agents

You may designate an authorized agent to submit requests on your behalf. We require written proof of authorization and may verify your identity directly. We may deny requests from agents who cannot demonstrate authorization.

9. International Data Transfers

Europe Awake™ is based in the United States, and we process and store personal information on servers located in the United States and other countries. If you access the Services from outside the United States, your personal information will be transferred to, stored, and processed in the United States and other jurisdictions where our service providers operate.

For transfers of personal information out of the European Economic Area, United Kingdom, or Switzerland, we rely on:

  • The European Commission's Standard Contractual Clauses (or UK equivalent)
  • Adequacy decisions by the relevant competent authority

11. Children's Privacy

The Services are not intended for children. We do not knowingly collect personal information from anyone under 13 years of age (or the applicable age of consent in your jurisdiction). We do not knowingly sell or share the personal information of consumers under 16 years of age.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the revised version on this page and update the "Last updated" date. For material changes, we will notify you by posting a prominent notice on the Services and, where required by law, by sending an email notification at least 30 days before the changes take effect.

For California residents, we will not apply material changes retroactively without your consent where required by the CCPA.
